Terms governing our text messaging services

1. SMS/MMS Consent and Terms
By opting in to Autumn Behavioral Health Center's ("ABHC") SMS/MMS messaging program, you consent to receive periodic text messages from us. These messages may include, but are not limited to: appointment reminders, treatment updates, wellness tips, service-related communications, and responses to your inquiries. Message frequency varies based on your treatment plan and interactions with our services.
2. Providing Your Telephone Number
By providing your mobile phone number and opting in to our messaging service, you represent that you are the owner or authorized user of the mobile device associated with that number. You agree to promptly notify us if your phone number changes or is reassigned. You can update your contact information by calling us at 614.219.9394 or emailing clinic@autumntreatment.com.
3. Consent to Receive Automated Communications
Consent to receive SMS/MMS messages is not a condition of purchasing any goods or services from Autumn Behavioral Health Center.
By opting in, you acknowledge that text messages may be sent using an automatic telephone dialing system or other automated technology. Standard message and data rates may apply depending on your mobile carrier and plan. ABHC is not responsible for any charges incurred from your carrier.
4. Opt-Out Instructions
You may opt out of receiving SMS/MMS messages at any time by using any of the following methods:
- Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any text message received from ABHC
- Call us at 614.219.9394 to request removal from the messaging program
- Email clinic@autumntreatment.com with your phone number and a request to unsubscribe
Upon opting out, you will receive one final confirmation message acknowledging your request. No further messages will be sent unless you re-opt in to the program.
5. Assistance / Help
For help with our messaging services, you may text HELP in response to any message you receive from us, or contact us directly at 614.219.9394 or clinic@autumntreatment.com.
6. Carrier Participation
Our messaging services are available on major U.S. carriers including but not limited to:
Carriers are not liable for delayed or undelivered messages. Service availability, coverage, and message delivery may vary by carrier and are not guaranteed.
7. Data Collection and Use
When you participate in our SMS messaging program, we collect the following data for service delivery purposes:
- Your phone number and carrier name
- Date, time, and content of messages sent and received
- Opt-in and opt-out status and history
For full details on how we handle your data, please review our SMS Privacy Policy. We do not sell, share, or transfer your opt-in data or phone number to third parties for marketing purposes.
8. Service Modifications and Termination
ABHC reserves the right to modify, suspend, or discontinue the SMS messaging program at any time without prior notice. We may also terminate your participation in the program if we suspect abuse, fraud, or violation of these terms.
9. Indemnification
You agree to indemnify, defend, and hold harmless Autumn Behavioral Health Center, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, or expenses arising from: (a) your provision of a phone number that is not your own or that you are not authorized to use; (b) your failure to update a changed or reassigned phone number; or (c) your violation of these terms and conditions.
10. Participation Requirements
To participate in our SMS messaging program, you must:
- Be at least 18 years of age (or have parental/guardian consent)
- Possess a compatible mobile device capable of sending and receiving SMS/MMS messages
- Have an active text messaging service plan with a participating carrier
- Provide valid and accurate opt-in consent
11. Message Frequency & Data Rates
Message frequency varies based on your treatment schedule, appointment activity, and interactions with our services. You may receive multiple messages per week during active treatment periods.
Message and data rates may apply. Please check with your mobile carrier for details about your messaging plan. ABHC is not responsible for any fees charged by your carrier.
12. Miscellaneous
If any provision of these SMS Terms and Conditions is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. These terms are governed by the laws of the State of Ohio. ABHC's failure to exercise or enforce any right or provision of these terms shall not constitute a waiver of such right or provision.
